How can you sell biocides in the EU/EEA if you are a company, established in the UK?

We get a lot of inquiries from companies, established in the UK, that want to expand their chemicals’ business in the European Union/European Economic Area (EU/EEA).

This time, I will focus on selling biocides. Since the UK is no longer part of the EU, the single European market is no longer available to companies, established in Great Britain – England, Scotland, and Wales.

So, what is the first step that you want to do, when planning to expand your biocides’ business to the EU/EEA?
 
Firstly, you need a company, established in the EU/EEA, to market the biocides there. However, Northern Ireland (NI) is a part of special Northern Ireland protocol, with access to the EU/EEA marketEU BPR still applies there. This means, that in general, a company, established in NI, can also register their biocidal products in the EU/EEA.

The other option is for the importers to make their own registrations. In some countries you need to have a local distributer in any case.

So let us say you are a company, established in the NI or you have local importers in each country.

What is the second basic requirement, you might want to check?

The second important aspect; is the active substance you are using in the biocide supplied from EU Article 95 list of suppliers? You can find the list here.

If these 2 basic requirements are fulfilled, then you can proceed with preparing the dossiers for the registrations of your biocides in the EU/EEA – The workload of preparing the dossier depends whether the substance is already approved in the EU or if it is still part of the Review Programme.
