If you're starting biocide production or planning to import them into Bosnia and Herzegovina, you're likely wondering what requirements you need to meet.
Today, I'll try to summarize the basic obligations for biocide manufacturers and importers in one place.
The level of obligations depends on where the manufacturer and importer are based in Bosnia and Herzegovina, as well as the target market. This is influenced by different regulations in various parts of the country.
As you may know, in the Federation of Bosnia and Herzegovina, there are still no regulations on biocides, and the term "biocide" is not defined. Poison regulations apply, and for each product, it must be checked whether it contains poisons. For products containing poisons, certain permits are required, which is also a requirement for all other chemical agents.
In the Republic of Srpska, the Law on Biocides is in effect, prescribing specific conditions for placing biocides on the market.
But everything always starts with chemical regulations, which largely apply to biocides as well. This means that biocide manufacturers and importers need to:
- be registered in the Register of Chemical Manufacturers and Importers,
- appoint a chemical advisor,
- properly classify and label the biocide, and
- prepare a safety data sheet.
Once you've met the basic obligations prescribed for all chemicals, you need to register the biocide. Given the lower level of obligations in the Federation of Bosnia and Herzegovina, registering a biocide in the Republic of Srpska generally allows you to sell biocides throughout Bosnia and Herzegovina.
It's crucial to note that you must check the status of the active substance contained in the biocide. The first condition for successful biocide registration is that it contains approved active substances.
Here are a few more important things to pay attention to.
- Only a legal entity can be a biocide manufacturer or importer.
- Only a registered entity can import biocides.
- Biocides from the European Union cannot be placed on the market without undergoing the registration process.
- Sometimes, it's not possible to register biocides in Bosnia and Herzegovina that are available in the European Union. Find out here what restrictions exist.
Keep in mind: even if your headquarters is in the Federation of Bosnia and Herzegovina, to sell biocides in the Republic of Srpska, you must meet the specified requirements.
After fulfilling all the chemical and biocide regulations, some products may have additional requirements. For products classified under tariff number 3808 in subcategories defined for insecticides, fungicides, and herbicides, a special import permit, known as a D permit, is required.
And don't forget, like other chemicals, biocides require record-keeping and annual sales reporting.
It's clear that placing biocides on the market requires meeting many conditions. And it's not always simple. That's why I hope texts like this can help you.
