
In today’s historic decision, Court of Justice dismissed the appeals from European Commission and France on the ruling of the General court – joined cases C-71/23 P & C-82/23 P.
This means that the classification of titanium dioxide as carcinogenic is annulled, as the 2022 General Court judgment is upheld.
What does this mean for the chemical industry:
- no more “H351 or H350” on labels or SDS for titanium dioxide
- EUH211/EUH212 phrases are removed
- cosmetics ban is removed
- court confirms only hazards from an intrinsic property count; “lung-overload” dust isn’t enough.
What should you do now?
- update and publish new versions of your Safety Data Sheets (SDS)
- print new labels for your products
- update PCN and REACH dossiers
- tell your customers: “classification and labelling withdrawn—here’s why.”
- keep one eye on ECHA; the Commission may start the process again with fresh data and different approach.
