The end of 2024 may mark the final PCN compliance deadline, but that doesn't mean you can afford to rest easy. In fact, tougher enforcement is just around the corner - and businesses like yours need to be prepared.
According to ECHA's own announcements, their Enforcement Forum is gearing up for a major crackdown on PCN compliance starting in 2025. According to ECHA:
»The objective of the checks is to protect human health by enforcing the requirement that suppliers of chemicals notify information about hazardous mixtures to the national authorities. The national authorities make that information available to poison centres so that they can give advice to citizens or medical personnel in the event of an emergency. Poison centres must have correct information about hazardous mixtures to ensure that the emergency response is well informed and appropriate.«.
These inspections will be thorough, checking that the PC notification has been submitted and verify labels of mixtures and – where needed – Safety Data Sheets.
And the consequences for non-compliance won't be pretty - fines, market access issues, and serious damage to your brand reputation are all very real possibilities.
So how can you make sure your business is ready?
My suggeston is to start by reviewing your current PCN submissions line-by-line. This includes things like:
- Are these PCNs accurate and up-to-date?
- Have you properly classified your mixtures and included all the required safety information?
- It's also a good idea to train your team on the latest compliance requirements, so everyone knows what to expect.
Staying on top of this can be a big undertaking, but it's absolutely essential.
The last thing you want is to be caught off guard when the inspectors come knocking.
